1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and H2 HVAC & HANDYMAN SERVICES LLC, doing business as H2 HVAC ("we," "us," or "our") , concerning your access to and use of the www.myh2hvac.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

4. SERVICES AND ESTIMATES

Information provided on this Site regarding HVAC, handyman, and appliance repair services—including but not limited to AC repair, mini split installation, furnace repair, and refrigerator or stove repair—does not constitute a binding contract. All formal service agreements must be executed in writing between H2 HVAC & HANDYMAN SERVICES LLC and the client. Any online estimates or consultations scheduled via the “Book Now” link or CRM integration are subject to on-site verification and official written approval.

5. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

6. SITE MANAGEMENT

We reserve the right, but not the obligation, to:

• Monitor the Site for violations of these Terms and Conditions.

• Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions.

• In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your contributions or any portion thereof.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS AND CONDITIONS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON.

8. GOVERNING LAW

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of Texas applicable to agreements made and to be entirely performed within the State of Texas, without regard to its conflict of law principles.

9. DISPUTE RESOLUTION

Any legal action of whatever nature brought by either you or us (collectively, the “Parties”) shall be commenced or prosecuted in the state and federal courts located in Denton County, Texas, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

10. CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
